In order for this guarantee to be valid, you must list your house with Tony Kawaguchi of RE/MAX 808 Realty for a term of 1yr, with a listing fee equal to 6% of the sales price.
The listing contract will state clearly that if your home is not in escrow after 90 days, $3000 will be given to you either as a check or at closing through escrow when your house sells.
If you get an offer from a buyer during the first 90 days of your listing contract, and you accept an offer from that buyer after the first 90 days, even if counter offers are presented in the mean time, this guarantee shall not apply and $3000 will not be paid.
If your home is in escrow during the first 90 days but it falls out of escrow, no money will be paid. If you decide to list your home at a price above what Tony Kawaguchi judges to be fair market value, then the listing agreement shall clearly state that the $3000 guarantee shall not apply.
If you cancel your listing before 6 months, the guarantee shall not apply. The $3000 shall be paid either as a check or at closing through escrow, to be determined by Tony Kawaguchi. This offer is not valid where prohibited by law.
